Making NCBC a constitutional body.

Making NCBC a constitutional body.

The 123rd Constitutional Amendment Act will lead to change in status of NCBC (National Commission for Backward Classes) from a statutory body (existence due to an act of Parliament) to a constitutional body (existence due to the constitution of India).

It will bring NCBC on a par with constitutional bodies like National Commission for SCs & STs. Currently, NCBC had no powers to hear the grievances of the Backward Classes. More power to the Commission for BCs will ensure that BCs are provided with safeguards against atrocities to them.

√ Articles:

Art. 338: National Commission for SCs

Art. 338 A: National Commission for STs

Art . 338 B: National Commission for BCs.

Cons: the BCs will be treated on a par with SCs & STs who had suffered caste discrimination & untouchability in the past. Though in case of BCs , the discrimination cannot be said to not to take place but providing BCs with the same safeguards as available to the SCs & STs is erroneous.

With Great Love,
